These Terms of Service (“Terms”) govern your access to and use of the websites, courses, memberships, and other services offered by Smart Fusion Marketing Inc. doing business as RiffNinja.com (“Riff Ninja,” “we,” “us,” or “our”). By accessing our Sites or purchasing any of our products, you agree to these Terms.

If you do not agree to these Terms, please do not use our Sites or services.

1. Use of Our Sites

You may use our Sites for lawful purposes only. You agree not to:

  • Copy, reproduce, distribute, or resell any course content, lesson videos, or materials without our written permission
  • Share your account login or allow others to access paid content through your account
  • Use our Sites to transmit spam, malware, or harmful content
  • Attempt to gain unauthorized access to any part of our Sites or systems
  • Use any automated tool to scrape or download content from our Sites

2. Accounts & Memberships

Some features of our Sites require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at customerservice@riffninja.com if you suspect unauthorized use of your account.

Memberships to Riff Ninja Academy are billed on a recurring basis (monthly or annually, depending on the plan you select). You may cancel your membership at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will retain access until then.

3. Payments

All prices are listed in USD unless otherwise stated. Payments are processed securely through Stripe or PayPal. By completing a purchase, you authorize us to charge your selected payment method for the amount shown at checkout.

We reserve the right to update our pricing at any time. Price changes to active memberships will be communicated with at least 30 days’ notice.

4. Our Guarantee

We stand behind our courses and memberships with a 60-Day Level Up Guarantee. If you put in the work and don’t feel like you’ve made real progress on guitar within 60 days of your purchase, contact us at customerservice@riffninja.com and we’ll refund your purchase in full — no questions asked.

This guarantee applies to individual course purchases and new memberships. Refund requests must be submitted within 60 days of your original purchase date.

5. Intellectual Property

All content on our Sites — including lesson videos, course materials, graphics, text, and branding — is owned by or licensed to Smart Fusion Marketing Inc. and is protected by copyright and other intellectual property laws.

Your purchase of a course or membership grants you a personal, non-transferable license to access that content for your own learning. You may not record, reproduce, distribute, publicly display, or create derivative works from our content without our express written consent.

The guitar techniques, songs, and musical concepts taught in our lessons may reference or be inspired by third-party musical works. We teach these for educational purposes. Riff Ninja does not claim ownership of underlying compositions or arrangements.

6. Digital Products & Access

Our courses are digital products delivered via online streaming. Upon purchase, you will receive access to the course materials through your account. We do not ship physical goods for digital course purchases.

We reserve the right to update, modify, or discontinue course content at any time. We will make reasonable efforts to maintain access to content you have purchased, but we cannot guarantee indefinite availability of specific materials.

7. Disclaimers

Our Sites and content are provided “as is” without warranties of any kind, express or implied. We do not warrant that our Sites will be uninterrupted, error-free, or free of viruses or other harmful components.

Results from following our guitar lessons will vary by individual. We make no guarantee that you will achieve any specific level of skill or musical ability.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Smart Fusion Marketing Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of our Sites or services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Third-Party Links & Services

Our Sites may contain links to third-party websites or integrate with third-party services (such as YouTube, Stripe, or PayPal). We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is governed by their own terms and policies.

10. DMCA & Copyright

We respect intellectual property rights. If you believe that content on our Sites infringes your copyright, please send a notice to customerservice@riffninja.com with the following information:

  • A description of the copyrighted work you claim has been infringed
  • The URL or location of the allegedly infringing material on our Sites
  • Your contact information
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

11. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.

12. Changes to These Terms

We may update these Terms from time to time. We will post a notice on our Site when material changes are made. Your continued use of our Sites after changes are posted constitutes your acceptance of the updated Terms.
